About the Fund

The Fund was established based on the Act on the Fund for Financing the Decommissioning of the Krško Nuclear Power Plant and the Disposal of Krško NPP Radioactive Waste and Spent Nuclear Fuel (Official Gazette 107/07 (in English)) to fulfill obligations undertaken by the Republic of Croatia in the Agreement between the Government of the Republic of Croatia and the Government of the Republic of Slovenia on Regulation of Status and Other Legal Issues Regarding Investments in Krško NPP, and its Exploitation and Decommissioning Official Gazette – International Agreements 9/02).

The Fund’s founder is the Republic of Croatia, which is jointly liable for contractual obligations of the Fund, and the Fund is accountable in respect of its work to the central state administration body in charge of energy affairs, i.e. the Ministry of Environment and Energy. 

The Act on the Fund came into effect on October 27, 2007; the Government of the Republic of Croatia appointed the Management Board and an Interim Director on February 7, 2008; in September 2008 the Fund began operations.

The Fund’s activities include activities related to the acquisition, maintenance and increase of value of assets for financing the preparation, review and implementation of the Krško Nuclear Power Plant Decommissioning and Radioactive Waste and Spent Nuclear Waste Disposal Program pursuant to Articles 10 and 11 of the Intergovernmental Agreement, and activities related to the coordination of preparation and drafting of the Krško Nuclear Power Plant Decommissioning and Radioactive Waste and Spent Nuclear Waste Disposal Program, pursuant to Radioactive Waste, Disused Sources and Spent Nuclear Fuel Disposal Strategy (Official Gazette 141/13).

Hrvatska elektroprivreda d.d. and GEN energija Ltd. share equal ownership of the Krško Nuclear Power Plant which means that HEP d.d., and, indirectly, the Republic of Croatia, is co-responsible for the decommissioning of the power plant and disposal of radioactive waste which was created during its operation and which will be created in its decommissioning. Such responsibility arises from generally accepted international norms and legally binding conventions which the Republic of Croatia joined, and was set out in the Intergovernmental Agreement. Council Directive 2011/70/EURATOM on SNF and RW Disposal acknowledges the specific case of Slovenian and Croatian joint responsibility for waste from Krško NPP and explicitly supports application of the Intergovernmental Agreement.

A Decision of the Government of the Republic of Croatia designated the Fund the expert organization for drafting joint radioactive waste disposal and Krško Power Plant decommissioning programs. In the fulfillment of this obligation, and in cooperation with the Slovenian expert organization, solutions will be advanced that are efficient in terms of human health and environmental protection and in terms of the economy, and all the activities related to radioactive waste and spent nuclear fuel management will be done in accordance with agreements, conventions, laws and good business practice.

Pursuant to the Act on Amendments to the Radiological and Nuclear Safety Act (Official Gazette 39/15), the Fund shall establish a Center for Radioactive Waste Management as an organizational unit, and implement activities related to the obligation of organization and implementation of radioactive waste management in Croatia.
